There could soon be an opening on Harris County Commissioners Court. According to a new lawsuit, Precinct 2 Commissioner, Adrian Garcia actually by law gave up his seat when he took another seat on the Gulf Coast Protection Board back in 2023.
"Accepting the conflicting position when you're already an office-holder, by Texas law of over 100 years means that he automatically resigned as Commissioner" said attorney Jerad Najvar, who filed the lawsuit.
And because of that, Najvar says that a special election needs to take place in May, because the seat is lawfully now vacant.
"Harris County Commissioners Court has an obligation to call an election" Najvar told KTRH, "And because they're not acknowledging that duty, we're going to court to force them to call that election."
There is legal proof that Garcia accepted and took on the position in 2023, which was illegal. Local pastor Richard Vega plans to run for the vacant seat, with court proceedings expected to start in the next couple of months.
