(Des Moines, IA) -- Iowa's state Supreme Court is upholding gun restrictions for people involuntary committed for mental health reasons. The case involves a man who underwent psychiatric evaluation as a teenager and was later denied a concealed carry permit as an adult. After petitioning a district court for his rights to be restored, he was denied again.
The judge denying the original petition said details about the man's mental health background were withheld during an ordered evaluation.
Under Iowa law, a person who has been denied can petition the court again for restoration of firearm rights every two years.
This is the first major test of a new 2022 amendment to the Iowa Constitution mandating that any and all restrictions of firearm rights shall be subject to strict scrutiny.
